Former Illinois State’s Attorney Given 60-Day Suspension For Dodging Service and Then Pulling Gun on Process Server

Former Union County State’s Attorney Allen W. James has been suspended for 60 days after pulling a gun on a process server after dodging prior service. Christopher Dees reported that he identified himself to James who proceeded to point his 380 semi-automatic handgun at him while trying to serve a complaint upon him. James insisted that he did nothing wrong, though he later pleaded guilty to a misdemeanor aggravated assault over the incident.

EmailPrintReprints A hearing board has recommended a 60-day suspension for an Illinois lawyer, finding that he pulled a loaded semiautomatic handgun on a process server in the parking lot of the Union County Courthouse while serving as the county's elected state's attorney.

Although Allen W. James claimed to have put his hand on the Kel-Tec .380 pistol in fear for his safety when approached by the unknown man on the morning of March 19, 2008, the three-member panel found that James—who had admittedly dodged service of a personal lawsuit at his office and home the previous day—either knew or had a strong suspicion that the man was a process server.

The Magistrate Court handles thousands of civil lawsuits each year, most resulting in judgments against one party or the other. One of the most-asked questions we hear from winning parties is, “How do I get my money?”

In today’s struggling economy, we want county citizens to get their money. And while we must remain neutral and cannot give legal advice, the court does have some self-help tools available. One of those tools is a set of forms and instructions we have developed for garnishment proceedings.

A garnishment action is one of the primary tools used to collect unpaid judgments. This court receives an average of 360 new garnishment cases per year, resulting in about 580 disbursals, or payments to judgment creditors, per year.
