Perjury trial set for Adrian man

ADRIAN, Mich.

A former process server accused of falsely certifying delivery of legal papers is facing a June 14 trial on felony perjury counts. William Eugene Millner, 33, of Adrian, waived arraignment Wednesday in Lenawee County Circuit Court on five perjury counts. Judge Timothy P. Pickard set the case for trial.

Estero bride-to-be faces foreclosure despite paying her bills

ESTERO — Natalie Pickens of Estero opened the door of her Fountain Lakes home one May night and found a process server standing on her doorstep.

He handed her a notice of foreclosure.

“I was like, ‘That’s pretty weird. I’m pretty sure we’ve paid the bills,’” the 22-year-old Pickens said she told him.

Annette Forte of Alden charged with filling false court documents NYS Attorney General's Office

BUFFALO, NY (WBFO) - An Erie County process server has been charged with filling false court documents that led to wrongful judgements.

State Attorney General Andrew Cuomo announce the indictment against 34-year old Annette Forte of Alden. She was arraigned in Lockport on the charges. The false documents of service were filed with County Clerk offices in Cattaraugus, Olean and Salamanca.

From August 2007 to April of 2008, Forte claimed she served and attempted to serve the legal papers against citizens who allegedly owed money to creditors.

Brooklyn Center server of court papers charged with lying about delivery

A Brooklyn Center man who served papers notifying people of lawsuits against them lied about completing the notifications for 13 people, leaving them facing default judgments for cases they didn't know about, according to criminal charges.

Angus McEachern, 23, was charged Wednesday in Hennepin County District Court with 13 counts of perjury. The court vacated 186 default judgments in response to the allegations. Default judgments are entered against civil defendants who fail to respond to a lawsuit.

McEachern told investigators that he signed about 200 false affidavits during the six months he was employed by Major Legal Professional Process Serving in 2008, the charges said.

Boulder woman suspected of shooting neighbor's home

BOULDER, Colo. — Boulder police have arrested a 49-year-old woman who they suspect fired a bullet from her home into her neighbor's house, nearly hitting her neighbor and that woman's 4-year-old daughter, said police spokeswoman Sarah Huntley.

Darine Chely turned herself into police Friday after firing the gun about 3:50 p.m. Thursday, Huntley said. She posted a $5,000 bond to get out of the Boulder County Jail and faces one felony and two misdemeanors: possession of a weapon by a previous offender, prohibited use of a weapon and reckless endangerment.

Police were called to the Dakota Ridge neighborhood in North Boulder by the neighbor, who told police that she was lying on her bed with her 4-year-old daughter when she heard a "loud boom," according to Huntley. She saw wooden blinds on a nearby window blow into the room and shatter into pieces, Huntley said...

Boulder Process Server Arrested and Charged with Fraud

A Boulder process server was arrested last week and charged with a felony count of forgery.

The charge against Darine Chely says she also uses the names Darine and Dee Bateman. She is reported to be the owner and operator of Quality Process Servers & Investigations.

The charge poses a legal problem for those who have relied on affdavits of service signed by Chely. Those who have done so are urged to contact Detective Carey Lutz at the Boulder Police Department at (303) 441-3333.

Chely was arrested Jan. 14 and released on posting of $10,000 bond. Her attorney is Ingird Bakke.

Fraudulent Tickets Tossed in Tucson

Over one thousand of American Traffic Solution’s photo fraud tickets will be dismissed in Tucson after it was revealed that the process server lied about their delivery.

If paid, the notices would have an estimated value of over $183,000.

Such breaches of justice and trust are becoming more the norm rather than the exception. In September, CameraFRAUD.com broke the story on a process server who used a racial slur while delivering a Redflex-generated notice. In December, the Phoenix New Times reported on a server who impersonated a UPS driver to deliver a notice, drawing the wrath and anger of UPS officials.

Complicated case changes hands

Judges in Santa Clara County are loath to touch a case with hundreds of pages of evidence, dozens of victims and four defendants - one of whom has opted to represent himself against a litany of charges.

Vincent Cardinalli, Sr., 65, his son Paul Greer, 31 - formerly Vincent Cardinalli, Jr. - Greer's sister Rosemary Ball and her husband Michael Ball face 169 counts of conspiracy, perjury, forgery, attempted grand theft and other felony charges stemming from hundreds of lawsuits filed by Cardinalli and Greer in hopes of collecting towing and storage fees for their now defunct towing businesses.

Half a dozen judges have passed the case like a hot potato and the most recent delay was brought on when attorneys convened Wednesday to set a date for a preliminary hearing and Superior Court Judge David Cena continued the case, in part because Cardinalli's motion for advisory counsel will be heard by another judge Jan. 27.
