Clarion Ledger - Apr. 3, 2012
A man and woman in their 50’s have been found shot to death in their home in Utica, according to a Hinds County Sheriff’s Department spokesman.
Officials are still searching for the next of kin, so names have not been released. The man is 56 years old, and the woman is 51, said Capt. Joe Daughtry.
A process server told authorities he went to the home at 4812 Mississippi 27 this afternoon around 1 p.m. to serve a paper. He saw a car in the driveway and looked in a window to see if the couple was home.

Dishonest Process Servers: A Mass Problem We Solve One Client At A Time
The Fullman Firm - Apr 01, 2012
In the first three months of 2012 our little firm has obtained vacation (reversal) of nine default judgments based on lack of notice. Many of these nine clients had been suffering from wage garnishments and bank levies, which were stopped due to our efforts. I spoke to four more victims of this practice yesterday. We are only one law firm. For every one person we help there must be a dozen who seek help from other firms and a hundred more who don’t seek help and suffer from wage garnishments and bank levies, or pay unreasonable settlements under threat of these collection practices.
Now let’s take a moment to cover how this whole “service of process” system works. I am repeatedly asked during our free consult calls whether the dishonest process server falsified the caller’s signature in order to accomplish the fraud. The answer is “no”, because THE PROCESS SERVER IS NOT REQUIRED TO GET YOUR SIGNATURE ON ANYTHING. Let’s meet the cast of characters in this little vignette.

Assembly Candidate Julio Perez Did Not Lie About Residency
Voice of OC - March 22, 2012
State Assembly candidate Julio Perez lives at the Santa Ana address he listed on his campaign filing, and he said Thursday he was treated unfairly by The Orange County Register, which first published a process server's statement that Perez does not live at the North Baker Street address.
“I’ve lived here since June 2010,” said Perez, who is disputing a sworn affidavit by a process server saying he does not live at the address where he is registered to vote and is within the boundaries of the 69th Assembly District, where he is seeking election.

Assembly Candidate Accused of Lying About Santa Ana Residency
Voice of OC - March 21, 2012
A process server has alleged that Julio Perez, candidate for the 69th Assembly District, doesn't live at the Santa Ana address listed on his candidacy filings, the Orange County Register reported Wednesday.
When the server arrived at the residence on N. Baker Street, Yolanda Estrada answered and said that Perez doesn't live there, according to the Register. A neighbor also said he had never heard of Perez.
Allegations against elected officials and candidates lying about their residency, a criminal offense, are common, but documentation to prove such allegations is rare.

Challenging Service of Process
Mark Stopa - March 20th, 2012 - Stopa Law Firm
A basic element of any lawsuit, including a foreclosure lawsuit, is a plaintiff’s obligation to effectuate service of process on a defendant. Service of process is a fundamental tenant of a defendant’s right to due process, as it ensures a defendant knows about a lawsuit and is given an opportunity to defend.
One of the things I enjoy most about foreclosure defense is challenging service of process when I believe it to be insufficient. When is that? Well, in my experience, bona-fide challenges to service of process invariably arise when the plaintiff tries to effectuate service by publication.

Watch Your Step...Answering Collection Lawsuits
John Skiba - 3/1/2012 - JDSUPRA
I meet with clients on a regular basis that have been sued by a debt buying company on an old credit card debt. If you have had the misfortune of being sued, you know that the process server provides you with a copy of the Complaint and Summons.
In Arizona, you have 20 days from the day you are served with the Complaint and Summons to submit a written response to the court. The written response is called the “Answer”. How you answer a lawsuit can have lasting implications in your collection lawsuit. Because of this, it is important to fully understand the process of answering a lawsuit and what things to avoid.

Process servers began many moons ago as a way to ensure that parties sued or accused received communication of the case and of their rights to due process. Many courts use electronic filing, and parties use email or programs like Lexis File & Serve to send one other pleadings.
And now service of process through the Internet.

Are Social Networking Sites replacing the Traditional Methods of providing notice of a Lawsuit?
With the advent of technology and massive use of social networking forums, it is only a matter of time before electronic service of process starts replacing the traditional methods of service of process.
Recently, a Judge in Minnesota was faced with the challenge of serving a husband with divorce papers where the wife had not seen her husband in years and had no physical address to serve him. The wife asked the court if she could send the notice by general delivery. According to the Judge, it did not make any sense to use general delivery as it would only result in waste of postage.

The garnishment process or ‘How do I get my money'
Gregory T. Douds - Cherokee Tribune - February 05, 2012
The Magistrate Court handles thousands of civil lawsuits each year, most resulting in judgments against one party or the other. One of the most-asked questions we hear from winning parties is, “How do I get my money?”
In today’s struggling economy, we want county citizens to get their money. And while we must remain neutral and cannot give legal advice, the court does have some self-help tools available. One of those tools is a set of forms and instructions we have developed for garnishment proceedings.
A garnishment action is one of the primary tools used to collect unpaid judgments. This court receives an average of 360 new garnishment cases per year, resulting in about 580 disbursals, or payments to judgment creditors, per year.
